1. Scope and contracting party

These terms apply to all transport contracts concluded through fr-transfer.de, by telephone or by email with FR Transfer, Friedrich Mohr Str 14, 56070 Koblenz, Germany.

Differing terms proposed by the customer do not become part of the contract unless we expressly agree to them in text form.

Journeys are carried out under the German Passenger Transport Act (PBefG). This is a pre-booked journey with a fixed pickup time — not a metered taxi ride and not a scheduled service.

2. Booking and formation of contract

The booking form and the price shown in it do not yet constitute a binding offer. By submitting the booking you make a binding offer to conclude a transport contract.

The contract comes into effect once we confirm the booking in text form, normally by email. It is that confirmation, not the form submission, that creates the entitlement to be carried.

You are required to state the pickup and destination address, date, time, number of passengers and amount of luggage completely and correctly. A telephone number on which you can be reached is required so the driver can contact you on the day.

For airport pickups the flight number must also be provided. Only with it can we track the flight and adjust the pickup time automatically if it is delayed.

3. Scope of service

What we owe is the carriage of the registered passengers and their luggage from the agreed pickup address to the agreed destination in the vehicle class booked.

The service operates 24/7. For pickups at Frankfurt Airport you are met in the arrivals hall of the relevant terminal (Terminal 1 or 3).

The vehicle class booked determines how many passengers and items of luggage can be carried. If the actual luggage substantially exceeds what was booked, the driver may decline to carry it where doing so would compromise road safety or the permitted load.

No particular vehicle model, colour or driver forms part of the contract. We reserve the right to provide an equivalent or higher-specification vehicle.

4. Prices

The amount shown during booking and stated in the confirmation is a fixed price. It does not change with the actual traffic, diversions, the time of day or the day of the week.

The fixed price includes the journey itself, tolls and vignettes along the entire route including cross-border sections, terminal parking charges for the pickup, the agreed waiting times, and statutory VAT.

We apply no night, weekend or public-holiday surcharges. Extras such as child seats, a name board or additional stops are selected during booking and then form part of the same fixed price.

Changes requested afterwards by the customer — additional stops, a different destination or more passengers — are not covered by the original fixed price and are charged separately.

5. Waiting times

For airport pickups, 60 minutes of waiting time from the actual landing are included in the fixed price. The actual landing time applies, not the scheduled one.

For pickups at an address with no associated flight, 15 minutes from the agreed pickup time are included.

Waiting time beyond that for which the customer is responsible may be charged according to the time involved. The driver will point out an impending overrun before the free waiting time expires, where contact is possible.

Delays for which we are responsible are never charged to you.

6. Payment

Depending on the option chosen, payment can be made online in advance, by card in the vehicle, in cash to the driver or — by prior arrangement — against an invoice.

For business customers we issue invoices containing all particulars required by § 14 UStG, on request as a collective invoice with cost-centre allocation. Invoiced amounts fall due without deduction within 14 days of the invoice date unless otherwise agreed.

Statutory provisions apply in the event of late payment.

7. Cancellation and rebooking

Bookings can be cancelled free of charge up to 24 hours before the agreed pickup time. Later cancellations, non-appearance and cancelled or delayed flights are governed by the separate cancellation terms, which form part of this contract.

Rebooking is preferable to cancelling and is normally free of charge where capacity allows. What counts is the time your message reaches us.

8. No statutory right of withdrawal

For contracts covering the carriage of passengers concluded for a specific date or period, consumers have no statutory right of withdrawal under § 312(2) no. 5 of the German Civil Code (BGB). This applies even where the booking was made online.

You therefore receive no withdrawal instruction — there would be nothing to instruct you about. In its place stands the contractual cancellation right under clause 7, which lets you cancel free of charge up to the stated deadline and so goes beyond the statutory minimum.

9. Passenger obligations

The driver's instructions concerning road safety must be followed. Seat belts are compulsory for all passengers.

Children must be secured as required by the German Road Traffic Regulations. Any child seats needed must be stated when booking so that they can be provided; without prior notice we may have to decline to carry children.

Animals may only be carried if notified in advance and appropriately secured.

Smoking, including e-cigarettes, is not permitted in the vehicle. Anyone causing soiling well beyond ordinary use, or damage, is liable under the statutory provisions.

10. Liability

We are liable without limitation in cases of intent and gross negligence, and for injury to life, body or health.

In cases of simple negligence we are liable only for breach of a material contractual obligation — one whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely. In such cases liability is limited to the foreseeable damage typical of this type of contract.

We are not liable for delays caused by force majeure, strikes, extreme weather, official orders, full road closures or unforeseeable traffic volumes. We recommend planning the pickup with a buffer and are happy to advise on this.

Liability under the Passenger Transport Act and the provisions of motor vehicle liability insurance remain unaffected.

11. Data protection

Which personal data we process for a booking, on what legal basis and for how long, is set out in the privacy policy.

12. Governing law and final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which a consumer is habitually resident remain unaffected.

If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is our registered office. Statutory places of jurisdiction apply in relation to consumers.

Should any provision of these terms be or become invalid, the validity of the remaining provisions is unaffected.
